A permit to apply pesticides is required under the following circumstances:

• Application to water
• Aerial application (by aircraft or helicopter)
• Application to state owned or leased land (1 acre or more)
• Application to state owned or leased right-of-way or greenhouse/nursery (of any size)
• Application to property owned by two or more persons

An exemption from the pesticide use permit requirements may be granted under the following circumstances:

• Application of anti-microbials used for oilfield operations
• Application of anti-microbials used for treatment of drinking water
• The commissioner determines that an emergency exists (requires written request and approval)
• Application is necessary for the safe operation of an airport (to non-public areas only, and requires written request and approval)
• Application is conducted as part of a research project (on 20 acres or less, and requires written request and approval)
