Schedule to Transfer Authority of Federal
NPDES Permitting and
Compliance / Enforcement Programs
On October 31, 2008, the Environmental Protection Agency (EPA) formally approved the state's National Pollutant Discharge Elimination System (NPDES) Program application. The state's approved program will be called the Alaska Pollutant Discharge Elimination System (APDES) Program.
Authority over the federal permitting and compliance and enforcement programs will transfer to DEC over four years beginning at program approval. Until authority over a facility transfers to DEC, EPA will remain the permitting and compliance and enforcement authority for that facility. On August 11, 2011 EPA approved ADEC's request for a transfer extension and Phase IV facilities will now transfer to ADEC on October 31, 2012. The EPA's decision is published in the August 23, 2011 Federal Register.
Authority will transfer in phases based on the APDES components listed below.
