DEC must submit an application to EPA to gain primacy of the NPDES program. Primacy means that DEC will issue and enforce wastewater permits in Alaska rather than the Environmental Protection Agency (EPA).
One component of the primacy application requires the State to adopt regulations to provide the necessary authority to implement the NPDES program. Once EPA approves the application, the State wastewater permitting program will be the Alaska Pollutant Discharge Elimination System (APDES) program. This public notification announces that the State’s proposed regulations to implement the APDES program are available for review and comment.
DEC will also hold public workshops and a hearing to ensure that Alaskans have an opportunity to learn about and comment on the proposed regulations.
